Distribution of Child Pornography

Transmitting child pornography to another individual through the use of a computer is a felony of the third degree under Florida law. A conviction for the transmission of material depicting sexual conduct by minors is punishable by up to 5 years in prison, 5 years of probation, and a $5,000 fine.

Under federal law, distribution or transmission of pornography involving minors under the age of 18 is a felony that requires a mandatory minimum sentence if convicted. The required minimum sentence for a first conviction is 5 years in prison, but the sentence may go as high as 20 years in prison. A second conviction requires a minimum of 15 years in prison, but the judge can sentence up to 40 years in prison.
