Lewd or Lascivious Molestation

Lewd or lascivious molestation is a crime that makes it illegal to intentionally touch in a lewd or lascivious manner the buttocks, breasts, or genitals of a child under the age of 16. The crime covers touching both over and under the clothes. Belief that the alleged victim was old enough to consent is not a defense to this crime.

The age of both the accused and the alleged victim play an important role in determining how severe the potential sentence can be. If the accused is 18 years of age or older and the alleged victim is under 12 years of age, then the offense is a “life” felony punishable by up to life in prison. If the accused was less than 18, and the alleged victim is less than 12, then the offense is a second degree felony which can result in a sentence of up to 15 years in prison, 15 years of probation, and a $10,000 fine. If the accused is 18 or over, and the alleged victim is over 12 but under 16 years of age, it is likewise a second degree felony. If the accused under the age of 18, and the alleged victim is over 12 but under 16 years of age, then the offense is a felony of the third degree punishable by up to 5 years in prison, 5 years of probation, and a $5,000 fine.
