Lewd or Lascivious Conduct

Anyone who touches a person under the age of 16 in a lewd or lascivious manner can be charged with lewd or lascivious conduct. This crime does not require that the alleged victim be touched in any specific part of the body.

If the accused is over the age of 18, then the crime is a second degree felony, which can result in a sentence of up to 15 years in prison, 15 years of probation, and a $10,000 fine. If the accused is under the age of 18, then the crime is a third degree felony punishable by up to 5 years in prison, 5 years of probation, and a $5,000 fine.
